The right of withdrawal, also referred to as the right of cancellation, allows individuals who have made a purchase or taken out a contract to reconsider their decision and terminate their commitment.
This right of withdrawal is granted to consumers under certain conditions by the Consumer Code. With regard to insurance contracts, the Insurance Code provides specific conditions for exercising the right of withdrawal:
the insurance contract must have been taken out following commercial solicitation. Therefore, contracts taken out in an agency or online do not give rise to a right of withdrawal where they were concluded outside the context of commercial solicitation;
the withdrawal request must be notified to the insurer by registered letter, either by post or electronically, within 14 full days following the signature of the contract;
withdrawal is no longer possible once a covered claim occurs, even during the statutory withdrawal period.
